1. Introduction

Welcome to Hashwake ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of the Hashwake platform, including our web application, data analysis tools, and subscription services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and Hashwake.

2. Description of Service

Hashwake ("Aggregate. Navigate.") is a cryptocurrency risk analysis dashboard that provides data visualization and analytical tools for cryptocurrency market analysis. Unlike tools that show sentiment as a timeline, Hashwake maps sentiment to risk. The Service includes:

  • Fear & Greed Index (FNG) tracking and historical analysis
  • Bitcoin and Ethereum risk metrics and volatility analysis
  • Interactive scatter plot charts with 4-year risk analysis
  • Pro features including cluster analysis, entry/exit signals, and price extreme detection
  • Subscription-based access to premium features and advanced analytics

The Service is provided for informational and analytical purposes only. We do not provide investment advice, and the Service should not be construed as financial, investment, or trading advice.

3. Eligibility and User Responsibilities

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding agreements in your jurisdiction to use the Service. You represent and warrant that:

  • You are of legal age in your jurisdiction
  • You have the authority to bind yourself or the entity you represent to these Terms
  • Your use of the Service complies with all applicable laws and regulations
  • You are not located in, or a resident of, any jurisdiction where the use of the Service is prohibited

3.2 Account Security

You are solely responsible for maintaining the security and confidentiality of your account credentials. You acknowledge that:

  • You are solely responsible for all activities that occur under your account
  • You must use a secure password and keep it confidential
  • You must immediately notify us of any unauthorized use of your account
  • We are not liable for any loss or damage arising from your failure to maintain account security

4. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Violating any applicable laws, regulations, or third-party rights
  • Using the Service for illegal activities or to facilitate illegal activities
  • Attempting to interfere with, compromise, or disrupt the integrity or security of the Service
  • Using automated systems, bots, or scripts to scrape, copy, or extract data from the Service
  • Reverse engineering, decompiling, or attempting to extract source code from the Service
  • Sharing your subscription account with unauthorized users
  • Redistributing or reselling data or analysis provided by the Service
  • Impersonating any person or entity or misrepresenting your affiliation with any entity

5. Data and Analytics Disclaimers

5.1 No Investment Advice

The Service provides data analysis and visualization tools for informational purposes only. You acknowledge and agree that:

  • We do not provide investment, financial, trading, or legal advice
  • All content, data, and analysis are for informational purposes only
  • You are solely responsible for your investment decisions
  • Past performance and historical data do not guarantee future results
  • Cryptocurrency markets are highly volatile and risky

5.2 Data Accuracy

While we strive to provide accurate and up-to-date information, you acknowledge that:

  • Data may contain errors, inaccuracies, or delays
  • We rely on third-party data sources that may be incomplete or inaccurate
  • We do not guarantee the accuracy, completeness, or timeliness of any data
  • You are responsible for verifying any information before making decisions based on it

5.3 Pro Features and Subscription

Access to Pro features requires an active paid subscription. You acknowledge that:

  • Pro features are subject to availability and may be modified or discontinued
  • Subscriptions are billed according to the plan you select
  • You may cancel your subscription at any time through your account settings
  • Refunds are subject to our refund policy and applicable law
  • We reserve the right to modify subscription pricing with notice

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HASHWAKE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or other intangible losses
  • Losses arising from your use or inability to use the Service
  • Investment losses or trading losses based on data or analysis from the Service
  • Losses resulting from data errors, inaccuracies, or delays
  • Losses resulting from unauthorized access to your account
  • Losses resulting from third-party data sources or services

Our total liability to you for any claims arising from or related to the Service shall not exceed the amount of fees you paid to us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

7. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free from viruses or other harmful components. We do not warrant that any data, analysis, or information provided through the Service is accurate, complete, or current.

8. Intellectual Property

The Service, including its design, text, graphics, logos, charts, analysis methodologies, and software, is owned by Hashwake or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. The Hashwake name, logo, and trademarks are our property and may not be used without permission.

9. Regulatory Compliance

You are solely responsible for ensuring that your use of the Service complies with all applicable laws and regulations in your jurisdiction, including but not limited to:

  • Securities laws and regulations
  • Tax laws and reporting obligations
  • Data protection and privacy laws
  • Consumer protection laws

We may be required to comply with applicable laws and regulations, including reporting suspicious activities to relevant authorities.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified through the Service or by other reasonable means. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

If you do not agree to the modified Terms, you must stop using the Service immediately.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, for any reason, including if you violate these Terms. Upon termination, your right to use the Service will immediately cease.

You may stop using the Service or cancel your subscription at any time. Termination does not affect any rights or obligations that arose before termination.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the European Union, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be resolved through good faith negotiations. If a dispute cannot be resolved through negotiations, it shall be subject to the exclusive jurisdiction of the competent courts in the European Union.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

15. Entire Agreement

These Terms, together with our Privacy Policy and Cookies Policy, constitute the entire agreement between you and Hashwake regarding your use of the Service and supersede all prior agreements and understandings.
